Alternative Dispute Resolution
Most disputes (more than 95% by most estimates), are resolved prior to trial. Many of those cases are resolved with the assistance of a mediator, who is a neutral third person who seeks to bring the parties to a mutually agreed upon settlement.
Alternative Dispute Resolution, at least mediation, provides an alternative for the parties to seek an end to a dispute which will avoid the costs and strife otherwise associated with litigation and trials. We always encourage our clients to very seriously consider alternatives to resolve their disputes.
If the parties reach an agreement, and if that agreement is properly memorialized, the courts will enforce it.
